What are Mass Torts?

While most people have a basic understanding of class action lawsuits, they are less familiar with mass torts. Class action lawsuits are actually a type of mass tort litigation. Similar to class action suits, mass tort claims involve a large number of plaintiffs acting against a common defendant. The primary difference, however, is that in class action suits, all the plaintiffs suffered almost identical injuries or damages. In mass tort lawsuits, the plaintiffs' injuries are more varied, so they do not fall into a single class.

Since 2016, Mr. Gregory has been providing representation to dozens of victims and their families after the Pulse Nightclub shooting, the worst in our history.

Types of Mass Torts

The most common types of mass torts are those involving product liability against manufacturers of defective medical devices or drugs. Product liability can encompass any defective product, such as cell phones, vehicles, or kitchen appliances. Premises liability is another common type of mass tort, and can encompass accidents that occur on commercial or residential property injuring a large number of people. Common examples of premises liability mass torts include a fire during a concert or movie, or a mass shooting similar to the Pulse Nightclub tragedy.

Mass Tort Litigation Process

To begin the mass tort litigation process, the victims must work together to file a lawsuit with an attorney. The attorney must then receive permission from the court to file the lawsuit as a mass tort action. Depending on the type of mass tort and the number of victims involved, the lawsuit may be filed with state or federal courts.

Mass tort actions can be brought against property owners, product distributors and manufacturers, and others. These types of lawsuits are generally high-profile cases and require strong legal representation. An attorney experienced in mass tort litigation will fight for the rights of each victim to secure adequate compensation for their severe injuries or damages.
